Flat purchasers find themselves in a fix: due to ignorant of the laws, at the mercy of builders who lay out their own regulations and rules, and are faced with the quandary of inaction or apathy of various branches of the government. The regulatory systems that should provide for protections and legal correctness are characterised by inefficiency and insufficiency, even if action is unavoidable. In such scenarios, most apartment complexes end up with facilities that don’t fulfil the statutory norms, bereft of facilities and amenities that can be crucial to safety and sufficiency. The final arbiter of such correctness is the often-elusive Occupancy Certificate, which the State must issue, providing for that vital certification. This can mean life and death, in eventualities like not just natural disasters but even in minor incidents and accidents that follow poor design, improper building norms, or elusive specifications. But, the state of affairs, as prevailing, has only meant that large numbers of buildings get occupied and exist without the vital OC.
Non-conveyance of common areas & amenities to the owners’ associations deprives the buyer of Property protections as becomes necessary when projects are to be managed well, appropriately; and/or may require to be modernized, redeveloped or rebuilt without a legal hurdle on land title and future development rights.
